Companion Puppy Sales Contract
This agreement is made and entered into this ____ day of _____, ____ by and between Vicki Gray of Artwyrks Havanese (Seller) and ______________(Buyer), for the purpose of setting forth the terms and conditions of purchase by the Buyer of a purebred Havanese from the litter whelped on _______out of ________________ and _________________.
For $_________, the seller agrees to sell and the buyer agrees to purchase a companion puppy, known as _________ from the litter described above subject to the following terms.
1. Seller warrants that the above-described puppy is a purebred Havanese
registered with the AKC and that the Seller will go online to complete the AKC registration at the date and time the Buyer takes possession of the puppy. The Seller will provide a true copy of its pedigree.
2. Seller warrants that the above-described puppy/dog is in good health at the time Buyer assumes ownership. Buyer agrees to have the puppy examined by a licensed Veterinarian with four (4) days (not including weekends and holidays) of receipt of puppy. If, as a result of the examination, the Veterinarian determines that the puppy is not in good health then the Buyer shall elect to keep the puppy or return the puppy to the Seller for a refund. If the buyer elects to return the puppy, Buyer shall return the puppy within 7 days after the date of the signing of this contract, along with a written Veterinarian's certificate stating that the puppy was in ill health when examined. Upon receipt by Seller of puppy and said certificate, the Seller shall be obligated to refund all monies received from Buyer toward the purchase price of the puppy, and further performance under this contract shall be null and void. All action taken to return the puppy shall be done with the best interest of the puppy in mind. Under no circumstances is the puppy to shipped.
3. Seller warrants that the puppy sold hereunder is to be clear of severe hip dysplasia, congenital deafness, severe cardiac disease, and juvenile cataracts. If said puppy/dog develops any of the above listed congenital health defects within 14 months from date of birth, the Buyer may elect to return the puppy to the breeder or keep the puppy. If the Buyer decides to keep the puppy, and surgery to correct juvenile cataracts or severe hip dysplasia is necessary, seller agrees to pay for surgical expenses up to a maximum of $500.00. If the Buyer elects to return the puppy, because of the puppy developing any of the above listed congenital health defects, the Buyer will receive a replacement puppy of like quality from the next available litter. If the Buyer elects to return the puppy to the breeder, it will be at the Buyer's expense. The Buyer shall provide written documentation from a canine ophthalmologist to verify the presence of juvenile cataracts, a cardiologist to verify cardiac disease, a hearing specialist to verify congenital deafness, and written documentation along with a copy of the hip x-rays from a licensed veterinarian to confirm the presence of severe hip dysplasia. Buyer shall be responsible for taking good and reasonable care of the puppy until Seller receives it. Costs and related expenses from the day the buyer takes possession of the puppy/dog, including but not limited to the cost of any veterinary care, health testing, and/or returning the puppy/dog to Seller shall be the obligation of the Buyer.
4. Ownership of the puppy/dog will be transferred to the Buyer for the sale price of $__________ to be paid as follows: $_________ nonrefundable reservation fee on execution of the Agreement with the balance of $_________ to be paid by cash on or before the puppy/dog leaves the Sellers premises.
5. If delivery is requested by Buyer, the puppy shall fly in the cabin with the seller or a representative chosen by the seller. Buyer is responsible for costs of crate, insurance during shipment, health certificate and cost of airfare, hotel expenses if necessary, and meals for the seller or seller’s agent and puppy. If Seller chooses to drive the puppy rather than fly, the buyer is responsible for mileage @ the going government rate, hotel expenses if necessary, and meals. Under no circumstances will an Artwyrks puppy be flown cargo.
6. The Seller and Buyer have agreed that the puppy/dog will not be shown nor used for breeding purposes. In such case, Seller shall provide Buyer with Limited Registration Certificate. Buyer agrees to have this puppy neutered or spayed, at six months of age. The Buyer agrees to provide a spay/neuter certificate from the veterinarian who performed the surgery.
7. Buyer agrees to maintain preventative health care of the puppy including, but not limited to annual veterinary exams, inoculations, and treatment for internal and external parasites. The buyer agrees to abide by Dr. Dodd’s protocol for immunizations.
8.Puppy will carry the ARTWYRKS kennel name.
9. Buyer agrees that he/she is not acting as an agent in the purchase or this puppy/dog and that Buyer will not sell this puppy/dog to any agent, pet store, or puppy mill.
10. Buyer agrees that if it becomes necessary to sell or otherwise dispose of this puppy/dog, Buyer will notify the Seller before taking such action so that the Seller may approve of the new owner. If the Seller does not approve of the proposed new owner, the Buyer must return this puppy/dog to the Seller. The Seller will attempt to place the puppy/dog in another suitable home, or will keep the puppy/dog and the Buyer will give up all claims to ownership, including signing a transfer of ownership on the AKC Registration Certificate back to the Seller.
11. Buyer agrees that the puppy will reside at the home of the Buyer, will not be chained or tethered, and will be provided with proper housing and exercise. Buyer agrees to keep puppy/dog in a fenced-in yard or on a leash when outdoors. Buyer agrees to feed the puppy Life's Abundance dog food purchased by auto ship through the Breeder's account. If the Buyer stops feeding Life's Abundance at any time, all health guarantees become null and void from that date forward. Buyer agrees that at least one basic obedience training course will be completed with the puppy/dog.
This Agreement is made and signed by both parties to ensure the wellbeing and protection of this puppy. If the Buyer breaches any part of this Agreement, the Seller is released from any
obligations under this Agreement.
